Terms & Conditions

  1. The contract

    The contract between ASAB and the customer will be formalized once ASAB is satisfied that the following conditions have been satisfied:

    1. The customer has agreed too, (signed and returned) the official ASAB Quotation.
    2. ASAB has received the deposit payment, namely 50% of the total sum of the quotation.

    Once said conditions (1.1 & 1.2) have been satisfied, ASAB will arrange for a “Final Check Measure” to be conducted at a mutually agreeable time, at which point the initial dimensions will be ratified, and any potential changes to the initial quotation specifications may be made accordingly.

    Further to this, ASAB reserves the right to alter any facet of the initial quotation based on the outcomes derived from the “Final Check Measure”.

    NOTE: Please note that should any alterations be made to the initial quotation specifications (Final Check Measure Stage) additional charges may be incurred.

  2. Payment methods

    Payments can be made via the following mediums.

    1. All major credit cards
    2. Debit cards
    3. EFT
    4. Humm Finance

    The customer payment card details will be encrypted to minimise the possibility of unauthorised access or disclosure, and authority for payment must be given at the time of order. Once said conditions 1.1 & 1.2 (and the Final Check Measure details) are satisfied, ASAB will commence the Order fulfilment process.

  3. Price

    The price the Customer is required to pay is the price shown on the final quotation (which will include any variation from the Final Check Measure stage). Once conditions 1.1 and 1.2 are fulfilled, the “Final Balance” will be confirmed to the Customer via a confirmation email. All quotation prices are inclusive of Goods and Services Tax (GST), and the (GST) value is also shown as a separate line item in the quotation.

    All prices shown in ASAB quotations are shown in Australian Dollars (AUD).

    NOTE: Please note that (other than the “Standard installation” as set out in the quotation) ASAB does not accept any liability for any Electrical works, or any other trade activities associated with the customer quotation, unless specifically stated in writing within the standard Quotation agreement.

  4. Cancellations

    As ASAB products are custom made, once the order has been placed with the manufacturer, ASAB is unable to change and or cancel a customer order. Cancelling an order prior to the order being placed is not an accepted practice, and will forfeit the Customers deposit. Should management decide to accept a cancellation (after the job has been ordered) ASAB reserves the rights to retain 20% of the value of the sale.

  5. Cancellations due to stock shortages

    ASAB reserve the right to cancel the customer’s order if:

    1. ASAB have insufficient stock to manufacture the goods ordered.
    2. Unbeknown to ASAB the goods ordered have been discontinued.
    3. A pricing, typing or systems error has occurred within ASAB’s database or ASABs website.

    If for any reason beyond ASAB reasonable control ASAB are unable to supply a particular item, ASAB will notify the customer as soon as possible. Please note that no discounts or compensation can be offered under these unforeseen circumstances, ASAB will however offer a range of suitable alternative, or the option of a full refund.

  6. Product descriptions and measurements

    1. Descriptions photos

      The products displayed on the ASAB Website, Quotations, Brochure’s and other Paraphernalia, are photographed or digitally produced, hence are an accurate representation of the ASAB product range. However due to the different styles and settings of computer monitors, coupled with the variations in document printing etc some colours may appear differently to the exact ASAB colour range. With this in mind, ASAB strongly advice’s that the customer request to view a sample of said goods before placing their order. This will ensure that the customer is happy with both the ASAB colour and also the style. Whilst every attempt will be made by ASAB to ensure that the goods sold match the Customers requirement, any sample or description shown or sent to the customer, or any minor or immaterial variation or change in ASAB colour or description delivered, shall not entitle the customer to reject the goods, nor to claim any compensation for such variation or change.

    2. Measurements

      The goods ASAB sell are made according to the specific customer requirements and sizes. It is ASAB’s responsibility to take the correct measurements of the customer dimensions before the order is placed. The customer however must check (and sign off on) the product details and measurements (Check Measure) of the goods before ASAB places the order with the Manufacture. ASAB cannot accept returns or provide refunds if the customer changes any of the measurement parameter conditions after the “Final Check Measure” details are confirmed.

    3. Made to measure products

      As most ASAB products are “Made to Measure” in order to meet the customer precise requirements, once manufactured, the goods cannot be cancelled or returned. ASAB advise that the customer take advantage of ASAB sample service from ASAB Sales Representative before placing an order. ASAB cannot be held responsible if the customer dislikes the colour or the general quality or style of the product after the order has been signed. ASAB strongly recommend that the customer double check their order to ensure that the products ordered are correct.

  7. Supply chain leadtime & the delivering of the customer goods

    Notwithstanding points (5.1, 5.2, 5.3) please note that our Supply Chain Leadtime are as follows:

    Awnings & Blinds 4 to 6 weeks from receipt of final Check Measure details

    Shutters 6 to 8 weeks from receipt of final Check Measure details

    All Custom Colours and Special Shapes 8 to 10 from receipt of final Check Measure details

    Whilst these lead-times are typically met, there are on occasions Manufacturing issues that can arise with the supplier. Said issues can extend the Lead Times as listed above. As ASAB has no control over these events, refunds and or financial compensation are not claimable. ASAB will however do everything in its power to expedite the delivery and subsequent Installation.

    NOTE: The Supply chain Leadtime does not commence from the date of contract initiation (1.1 / 1.2). The Supply chain Leadtime does commences from the date of receipt of the final Check Measure information. We recognise that the Final Check Measure details could be affected by the Customers or Installers availability and or questions and variations associated with the installation, hence the ordering process (Leadtime) cannot commence until such time as all parties (ASAB and the Customer) agree on the Final Check Measure details.

    Please also note that said lead-times are based on a landed timeframe, at which point the ASAB team will be in contact with you to arrange final payment and Delivery.

    Not-withstanding the fulfilment of point 7.1 (below) ASAB will then deliver the customer goods to the address as shown on the customer quotation, at a mutually agreed Day / Time.

    1. Payment of the remaining 50% balance has been obtained.

    NOTE: Deliveries are Normal Business Week days (Monday to Friday) either am or pm.

  8. Defective goods

    ASAB offer a 12-month manufacturer’s guarantee on manufacturing faults. In addition to this ASAB offer a limited guarantee for a further 4 years making a total of 5 years. In the instance that Defective goods are detected, ASAB reserve the right to replace or repair the product (goods) as per the Consumer Guarantee guidelines. Please read ASAB full Warranty Policy located on ASAB’s website for further details.

  9. Representations

    No statement, description, or recommendation contained in any catalogue, price list, advertisement, communication, or by any employee or agent of ASAB shall be interpreted so as to enlarge, vary or override in any way any of these terms and conditions.

  10. Events beyond ASAB’s control

    ASAB shall have no liability to the customer for any failure to deliver goods or for any delay, or for any change of the specified delivery date, that is caused by any event or circumstance beyond ASAB reasonable control including without limitation, third party default, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, Explosion’s, Pandemic’s or accident. ASAB will however work with the supplier in order to bring said order to fruition as soon as possible in this event.

  11. Invalidity

    If any part of these terms and conditions is unenforceable (including any provision in which ASAB exclude ASAB liability to the customer) the enforceability of any other part of these conditions will not be affected.

  12. Privacy

    ASAB do not sell, trade or rent the customer personal information to others.

  13. Consumer guarantee

    In line with Australian Consumer regulations ASAB have a duty to provide the customer with the product the customer ordered. If a part is missing or incomplete, ASAB will replace said Part / Parts as quickly as possible in accordance with the Consumer Guarantee. A refund will only be given if ASAB cannot replace or repair the item. ASAB will not be responsible for any installation charges that the Customer incurs as a result of the Customer contracting a third-party rectification solution. It should be noted also that if the Customer chooses to enlist the services of a 3rd party contractor for the purposes of rectifying a product fault (as opposed to using a qualified ASAB technician) the product Warrantee’s will be void.

  14. Additional charges

    Further to point 7.1, should the Customer delay the execution of the final payment for a period of equally to or greater than two weeks, ASAB reserves the right to charge a Demurrage fee of $35 per week, until such time as the final payment has been executed. Said addition charges will be added to the Final Balance. Under this circumstance, once the full outstanding balance has been fulfilled, ASAB will commence the process of coordinating the Installation process.
